The Divorce Store® Arizona Guardianship Kit includes all of the forms required to bring an action in the Arizona Superior Court for the appointment of a single guardian or two joint guardians of one or more minor children.

The appointment of a guardian under the procedures provided in this kit is a permanent appointment of the guardian to the extent that it will take a Court action to terminate the guardianship once it becomes final.

There is however, another procedure available under Arizona Laws (A.R.S. Section 14-5104) that allow for a temporary appointment of a guardian for a period of up to six months.

The form for this temporary guardianship is called a 'Special Power of Attorney Over Minor Child,' which is available either from the publisher of this kit, the dealer where this kit was purchased, or at most Bookstores, Copy Services, Mailing Services, Office Supply and Stationery Stores.

The authorities granted under the Special Power of Attorney Over Minor Child are restrictive to the extent that in addition to being effective for only 6 months, it does not confer authority to consent to the marriage of the minor child, nor can it be used to establish the child's residence for admission to a local school.

The restrictions outlined immediately above do not apply to guardianships granted under the procedures provided in this kit, since the power and authority conferred under this type of guardianship is, in most respects, identical to the power and authority enjoyed by the natural or adoptive parent, except the obligation to financially support the child.

In other words, the natural parent remains obligated for the financial support of the minor child, notwithstanding the appointment of another person to be the minor child's guardian. The exception to this obligation by the natural parent occurs when the minor child is adjudicated to be a ward of the State of Arizona.

Before you commence the preparation of the forms included in this kit, be sure and read all of the Chapters that follow this Introduction, as it is important that you understand what is required to successfully accomplish the guardianship action.
