The author and his staff extend a note of thanks to you for your consideration of our professionally designed The Divorce Store® Pre-Marriage Kit and your mature desire to minimize many of those differences that seem to somehow surface when relationships become strained or the parties simply lack the ability or desire to communicate.
With this in mind, the material that follows will briefly describe the contents of The Divorce Store® Pre-Marriage Kit and what it can provide in the way of inspiring the parties who plan to either solemnize the marriage, or simply live together, to consider the treatment of their present and future financial resources. This is of course a small price to pay for easing the frustrations and expense of terminating a marriage or living arrangement.
The Divorce Store® Pre-Marriage Kit includes both pre-marriage agreements with supporting instruments and living together (co-habitation) agreements with supporting instruments. In other words, it is essentially two kits, namely: one that provides two types of pre-marriage agreements (separate or shared properties), which are designed to allow the parties the option of either keeping their separate property separate and apart or fully sharing their separate properties or other financial resources; and the other which provides two types of living together agreements (separate or shared properties) which are also designed to allow the parties the option of maintaining a living arrangement with each party not sharing their separate properties, or with a complete sharing of each party's separate property.
There are also supporting instruments for both pre-marriage and living together agreements which provide: (1) The disclosure of each party's properties; (2) Disclaimer agreements that allow either party to disclaim or disown any rights, or an appearance of any rights, or an interest in the other party's property; (3) A monthly expense a agreement which reduces to writing who pays what portion of the monthly living expenses, and (4) a termination agreement which provides either party, or both parties together, with written notice terminating the living together agreement.
It, therefore, does not matter if the planned living arrangement will be a solemnized marriage, a trial marriage, or a common law marriage, since this kit provides an invaluable service either way.
At this point, the anticipation of examining and preparing the forms is probably great, but keep in mind that the most important task ahead is not the immediate preparation of the forms but gaining an understanding as to what the forms will and will not accomplish. Therefore, with this said, just remember that all of the material that follows should be read with an understanding before commencing the preparation of any of the Forms.
In Chapter Five, there is a complete and through description of each of the included forms. You should make liberal use of these descriptions since they clearly show their exact and legal purpose.
When you are ready to start the preparation of the forms, you will need to read Chapter Six, The Steps Of Procedures, which will guide you through the selection, preparation and filing of the required forms.
Also, since the considerations of both pre-marriage and living together can 'involve issues regarding both real and personal property, a Glossary of some common real and personal property words and phrases is included in this text starting on Page 21. Therefore, if you should encounter an unfamiliar word or phrase in this text that appears descriptive or pertains to either real or personal property, then you will in all likelihood find it in this Glossary.
The real purpose of this Glossary is then to assist you in your understanding of all of the text material, agreements and forms included in this book, plus those real-life situations, which involve the knowledge and use of real and personal property words and phrases.
